BACKGROUND AND PURPOSE

Legislation passed by the 75th Legislature, authorized a county with a
population of 2.8 million or more or a public health district at least part
of which is in a county that has a population of at least 2.8 million or
more to recover at least 50 percent of its costs for reviewing and acting
on permits, amending and renewing permits, and conducting inspections.
C.S.H.B. 3469 authorizes a county that has a population of at least 2.8
million or is adjacent to a county of 2.8 million or a public health
district at least part of which is in a county that has a population of at
least 2.8 million or is adjacent to a county of 2.8 million to require the
payment of a fee for issuing or renewing a permit or for performing an
inspection.

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.

authorize a county that has a population of at least 2.8 million or is

COMPARISON OF ORIGINAL TO SUBSTITUTE

This substitute further amends SECTION 1 (Section 437.0123(a), Health and
Safety Code), by authorizing a county that has a population of at least 2.8
million or is adjacent to a county of 2.8 million, rather than by
authorizing a county that has a population of 300,000, or a public health
district at least part of which is in a county that has a population of at
least 2.8 million or is adjacent to a county of 2.8 million, rather than in
a county that has at least 300,000, to require the payment of a fee for
issuing or renewing a permit or for performing an inspection to enforce
this chapter or a rule adopted under this chapter.
