BACKGROUND AND PURPOSE 

Currently, the Brazos River Harbor Navigation District (district) does not
have a district treasurer. H.B. 3568 provides for the appointment of a
district treasurer and requires the treasurer to perform all the duties for
the district that were previously performed by the Tax Assessor and
Collector for Brazoria County. 
 
RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Chapter 58, Acts of the 62nd Legislature, Page 110,
Section 1, Regular Session, 1971, by adding Section 2 and Section 3, as
follows: 

SECTION 2.  Establishes the Office of District Treasurer (treasurer) of
Brazos River Harbor Navigation District of Brazoria County (district).
Requires the Board of Navigation and Canal Commissioners of the Navigation
District (board) to appoint the treasurer.  Requires the treasurer to
perform all duties for the district as have previously been performed by
the County Treasurer of Brazoria County.  Requires the Tax Assessor and
Collector for Brazoria County, or the person performing the Tax Assessor
and Collector's duties, to deposit all taxes collected for the district in
the depository bank that is designated as depository for Brazoria County
and transfer and deposit the money to the account of the district in the
depository bank designated as the depository for the district. 

SECTION 3.  Requires the treasurer to execute a good and sufficient bond
payable to the board for the benefit of the district in an amount fixed and
approved by the board before receiving any district funds. 

SECTION 4.  Effective date: September 1, 1999.
