HBA-DMD H.B. 359 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 359 By: Wise Public Education 4/11/1999 Introduced BACKGROUND & PURPOSE Currently, only school districts that contract with private entities in order to provide prekindergarten programs are required to comply with all applicable child-care licensing standards of the Department of Protective and Regulatory Services (department). H.B. 359 provides that all school district prekindergarten program must, at a minimum, comply with the applicable child-care licensing standards of the department. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 29.153(g), Education Code, to delete the provision which refers to a school district's contract with a private entity for the operation of a prekindergarten program to provide that a school district must comply with the child-care licensing standards adopted by the Department of Protective and Regulatory Services under Section 42.042, Human Resources Code. SECTION 2. In accordance with Section 311.031(c), Government Code (Saving Provisions), which gives effect to a substantive amendment enacted by the same legislature that codifies the amended statute, this Act gives effect to changes made by Chapter 920, Acts of the 74th Legislature, Regular Session, 1995. To the extent of any conflict, this Act prevails over another Act of the 76th Legislature, Regular Session, 1999, relating to nonsubstantive additions and corrections in enacted codes. SECTION 3. Makes application of this Act prospective beginning with the 1999-2000 school year. SECTION 4. Emergency clause. Effective date: upon passage.
