HBA-ALS, MAJ H.B. 361 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 361 By: Wise Public Education 2/10/1999 Introduced BACKGROUND AND PURPOSE Under current law, school district trustees do not receive any compensation for serving on the board of trustees. Trustees may incur certain personal expenses in the cause of their service. H.B. 361 allows a school district trustee to receive compensation if it is approved by the voters in a district election. However, H.B. 361 stipulates that such an election may not be held solely for the purpose of submitting an issue regarding trustee compensation, and still prohibits trustees from receiving compensation under certain circumstances. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 11.061(d), Education Code, to include a provision authorizing a school district trustee to receive compensation of a specified amount if the compensation is approved by a majority of the votes cast at an election held in the district. Prohibits trustees from holding an election for the sole purpose of submitting a measure on trustee compensation to the voters. Prohibits a trustee, notwithstanding this subsection, from receiving compensation if the trustee holds an office other than the position of trustee that is considered a civil office of emolument under Section 40, Article XVI, Texas Constitution (Holding More than One Office; Exceptions; Right to Vote), or receives other compensation directly or indirectly from the state. SECTION 2. Emergency clause. Effective date: upon passage.
