BACKGROUND AND PURPOSE 

Prior to the 76th Legislature, a navigation district having within it a
city with a population of over 250,000 had the authority to exchange land
or interests in land with other landowners.  H.B. 3620 extends that
authority to any navigation district.  This bill also specifies that the
land can be exchanged with public or private entities.  This bill also
provides that it does not affect a limitation or condition contained in a
lease of land by the state to a navigation district, a conveyance of land
from the state to a navigation district under former Article 8225,
V.T.C.S., any other general or special law, or in any way affect Sections
61.116 (Lease of State Owned Land and Flats) or 61.117 (Limitations on
Sales and Use of State Lands and Flats), Water Code. 
 
RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 1, Article 8247f, V.T.C.S. (Chapter 176, Acts of
the 54th Legislature, Regular Session, 1955), to provide that the governing
board of a navigation district, rather than only a district which contains
a city with more than 250,000 population, has the authority to exchange
lands with any other public or private landowner, or convey to another
state or federal governmental entity, person, firm or corporation lands
owned and held by the navigation district.  Makes a nonsubstantive change. 

SECTION 2.  Provides that SECTION 1 does not affect a limitation or
condition contained in a lease of land by the state to a navigation
district, a conveyance of land from the state to a navigation district
under former Article 8225, V.T.C.S., any other general or special law, or
in any way affect Sections 61.116 (Lease of State Owned Land and Flats) or
61.117 (Limitations on Sales and Use of State Lands and Flats), Water Code. 

SECTION 3. Emergency clause.
  Effective date: upon passage.
