In addition, numerous private, nonprofit, or community-based organizations are currently engaged in job training and vocational education. The purpose of this bill is to include community-based organizations among the entities which may use the skills development fund. In addition, C.S.H.B. 3656 authorizes community-based organizations to apply for funds to participate in training programs, only in partnership with community or technical colleges or the Texas Engineering Extension Service. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 303.001, Labor Code, as follows: Sec. 303.001. New title: PURPOSE; DEFINITIONS. Includes community-based organizations among entities in this section in regard to the removal of administrative barriers and the need to develop incentives. Defines "community-based organization" for the purposes of this chapter. Makes a nonsubstantive change. SECTION 2. Amends Section 303.003, Labor Code, to include community-based organizations among the entities which may use the skills development fund. Authorizes community-based organizations to apply for funds to participate in training programs, only in partnership with community or technical colleges or the Texas Engineering Extension Service. Provides that community-based organizations providing services that are regulated by the state must provide evidence of required certification, license, or registration. SECTION 3. (a) Effective date: September 1, 1999. (b) Makes application of Section 303.003, Labor Code, as amended by this Act, prospective. SECTION 4. Emergency clause. COMPARISON OF ORIGINAL TO SUBSTITUTE C.S.H.B. 3656 modifies the original to conform to Legislative Council format. C.S.H.B. 3656 modifies the original in the caption to make a nonsubstantive change. C.S.H.B. 3656 modifies the original in SECTION 1 (Section 303.001, Labor Code) by redesignating proposed Subsection (c) to Subdivision (b)(2). The substitute makes other nonsubstantive changes. C.S.H.B. 3656 redesignates SECTIONS 3 and 4 (effective date) of the original to SECTION 3 in the substitute. C.S.H.B. 3656 modifies the original emergency clause by redesignating it from SECTION 5 and by providing a short, rather than long, emergency clause.
