HBA-SEB H.B. 3724 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3724 By: Bailey Urban Affairs 4/1/1999 Introduced BACKGROUND AND PURPOSE Currently, the Local Government Code establishes civil service requirements for fire fighters and police officers in a city with a population of 1.5 million or more that has adopted the Fire Fighter and Police Officer Civil Service Act. At this time, only the City of Houston is affected by the civil service requirements. H.B. 3124 amends the Local Government Code to require that all fire fighters meet the civil service requirements. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter G, Chapter 143, Local Government Code, by adding Section 143.1052, as follows: Sec. 143.1052. CLASSIFICATION. Requires all work of a type that is described in the definition of "fire fighter" to be performed and supervised by fire department personnel who are classified in accordance with Section 143.021 (Classification; Examination Requirement). Provides that this section does not apply to the work of the chief of the fire department, the assistant chief of the fire department, and purely clerical personnel. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
