HBA-NMO H.B. 3763 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3763 By: Gallego Natural Resources 4/5/99 Introduced BACKGROUND AND PURPOSE The 74th Texas Legislature enacted legislation exempting certain water wells from regulation by water districts created after September 1, 1991. This exemption hinders the Jeff Davis County Underground Water Conservation District, created in 1993, in the effective management of its water resources. H.B. 3763 provides that the exemption set forth in Section 36.121 (Limitation on Rulemaking Power of Districts Over Wells in Certain Counties), Water Code, does not apply to the Jeff Davis County Underground Water Conservation District. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 5, Chapter 641, Acts of the 73rd Legislature, Regular Session, 1993, by adding Subsection (c), as follows: (c) Provides that Section 36.121 (Limitation on Rulemaking Power of Districts Over Wells in Certain Counties), Water Code, does not apply to the Jeff Davis County Underground Water Conservation District. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
