HBA-RBT H.B. 3764 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3764 By: Gallego Natural Resources 4/5/1999 Introduced BACKGROUND AND PURPOSE The 73rd Legislature enacted legislation creating the Jeff Davis Underground Water Conservation District (district) in 1993. In 1995, the 74th Legislature amended the Water Code by enacting Section 36.121, to exempt certain wells from regulation by water districts created after September 1, 1991. Section 36.121,Water Code, largely restricts the district from managing its water resources and allows water users to transfer water out of the district without regard to other needs in the county. H.B. 3764 repeals Section 36.121, Water Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 36.121 (Limitation on Rulemaking Power of Districts Over Wells in Certain Counties), Water Code. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
