HBA-GUM, RBT H.B. 3775 76(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 3775 By: Olivo Criminal Jurisprudence 7/27/1999 Enrolled BACKGROUND AND PURPOSE Prior to the 76th Texas Legislature, a justice of the peace had the authority to order certain people to take a blood sample of a deceased person who had been in a motor vehicle accident. H.B. 3775 adds a paramedic to that list. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 49.10(j), Code of Criminal Procedure, to include a paramedic among those persons a justice of the peace may authorize to take a specimen of blood from the body of a person who died as the result of a motor vehicle accident. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
