BACKGROUND AND PURPOSE 

Current law restricts the execution of a survivorship agreement on a
certificate of title for a motor vehicle or mobile home to a husband and
wife.  By allowing only a husband and wife to pass on the title of a motor
vehicle or mobile home to each other, problems may arise, for example, in
the passing of a motor vehicle or a mobile home from a widow to the widow's
child.  H.B. 381 provides that a survivorship agreement on a certificate of
title for a motor vehicle or mobile home is to be signed by "two persons,"
rather than "husband and wife." 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 501.031, Transportation Code, to provide that if
the survivorship agreement on a certificate of title is signed by "two
persons," rather than by "a husband and wife," the motor vehicle title is
held jointly by those persons with the interest of either "person," rather
than "spouse," who dies to survive to the surviving "person," rather than
"spouse." Makes conforming changes. 

SECTION 2.  Amends Section 19(a) (2), Texas Manufactured Housing Standards
Act, Article 5221f, V.T.C.S., to provide that a  title document should be
issued in both names if "two persons," rather than "a husband and wife,"
file with the application for document of title, an agreement signed by
both providing that the manufactured home is to be held jointly with rights
of survivorship. 

SECTION 3.  Amends Section 19(h), Texas Manufactured Housing Standards Act,
Article 5221f, V.T.C.S., to make conforming changes. 

SECTION 4.  Effective date: September 1, 1999.

SECTION 5.  Emergency clause.
