HBA-RBT H.B. 3823 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3823 By: Zbranek Natural Resources 4/20/1999 Introduced BACKGROUND AND PURPOSE The Chambers-Liberty Counties Navigation District was established in 1944 to provide drainage and water supply for residents of the rural areas. Since that time, Texas statutes have set the selection process of the commissioners of the navigation district. H.B. 3823 changes the number of commissioners from three to five members in order to facilitate better representation for a now significantly larger population. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Provides for the appointment of the navigation and canal commissioners of ChambersLiberty Counties Navigation District. Sets forth the procedure for appointment by the commissioners court of Chambers and Liberty County. Provides that the members of the commission of the Chambers-Liberty Counties Navigation District serve staggered four year terms. SECTION 2. Requires the commissioners court of each county in the Chambers-Liberty Counties Navigation District to appoint members to the navigation and canal commission on January 15, 2000. Sets forth the terms of the members appointed. Provides that all navigation and canal commissioner's terms expire on January 15, 2000, but that the current commissioners can be reappointed to the commission. SECTION 3. States that all requirements of the constitution and laws of this state and the rules and procedures of the legislature with respect to the notice introduction, and passage of the Act are fulfilled and accomplished. SECTION 4. Effective date: January 1, 2000. SECTION 5. Emergency clause.
