HBA-RBT H.B. 3847 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 3847 By: Ritter Natural Resources 4/28/1999 Introduced BACKGROUND AND PURPOSE Currently, special restrictions are placed on the Jefferson County Drainage District No. 7. These restrictions were put in place prior to the enactment of the Water Code. H.B. 3847 requires this district to comply with Chapter 49, Water Code, rather than the special legislation. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Sections 3, 4, and 13, Chapter 34, Acts of the 57th Legislature, 3rd Called Session, 1962, to require purchases and contracts to be made in accordance with Chapter 49 (Provisions Applicable to all Districts), rather than Section 50.061, Water Code. Provides that moneys of the Jefferson County Drainage District No. 7 (district) are to be disbursed on instruments issued in accordance with Chapter 49, Water Code. Provides that the commissioners of the district are elected in accordance with Subchapter D (Election Provisions), Chapter 49, Water Code and serve four-year terms. Provides that Subchapter G (Audit of Districts), Chapter 49, Water Code, applies to audits of the district's fiscal accounts and records. Provides that Sections 56.070-56.072 (Treasurer, Treasurer's Bond, and Treasurer's Compensation), Water Code, do not apply to the district. Deletes text relating to provisions of statutes and procedures that are replaced by provisions in Chapter 49, Water Code. SECTION 2. Effective date: September 1, 1999. Sets forth the terms of commissioners and the procedures for elections. SECTION 3. Emergency clause.
