BACKGROUND AND PURPOSE 

Currently, campus report cards do not include comprehensive information
regarding the academic performance of students at each grade level or the
number of students who drop out of school at the high school level.  H.B.
387 requires the portions of campus report cards disseminated to the parent
or person with lawful control over a student to include information about
the performance of the students at each campus grade level on certain
academic excellence indicators and also requires the number and percentage
of students at each campus grade level who have dropped out during the
school year to be included on report cards relating to the high school
campus. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that the rulemaking
authority previously delegated to the commissioner of education is modified
in SECTION 1 (Section 39.052(c)) of this bill and is expressly delegated in
SECTION 2 of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 39.052(c), Education Code, to delete "guardian"
and "conservator" from a list of persons to whom the Texas Education Agency
is required to send student performance portions of campus report cards, so
that the list will read simply "parent or other person having lawful
control of each student."  Requires the portions of campus report cards
disseminated to the parent or person with lawful control over a student to
include information about the performance of the students at each campus
grade level on the academic excellence indicators specified under Sections
39.051(b)(1)-(8)(Academic Excellence Indicators).  Requires the number and
percentage of students at each campus grade level who have dropped out
during the school year to be included on report cards relating to the high
school campus. 

SECTION 2.  Requires the commissioner of education to adopt rules in
accordance with this section no later than January 1, 2000.  Specifies that
the rules apply to public school campus report cards for the 2000-2001
school year and thereafter. 

SECTION 3.  Emergency clause.
            Effective date:  upon passage.
