HBA-ATS H.B. 502 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 502 By: Tillery Public Health 4/13/1999 Introduced BACKGROUND AND PURPOSE The Texas Funeral Service Commission (commission) is required by statute to employ or contract for the services of persons to investigate complaints received by the commission. To qualify as an investigator, a person must be a private investigator licensed in this state, a private investigator previously licensed under state or federal law, or an investigator previously employed by a law enforcement agency. H.B. 502 repeals the mandate that the commission hire certain qualified individuals to serve as investigators, thus giving the commission the latitude to establish and implement its own standards for hiring investigators. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Repealer: Section 6D(f), Article 4582b, V.T.C.S. (Complaints). Section 6D(f) requires the Texas Funeral Service Commission to employ persons to investigate complaints received by the commission, and prescribes the qualifications such persons must have in order to be hired. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
