BACKGROUND AND PURPOSE 

Current law provides that the staff development provided by a school
district must be conducted in accordance with minimum standards developed
by the commissioner of education, or a person designated by the
commissioner,  for program planning, preparation, and improvement.
C.S.H.B. 578 provides that the staff development must include training in
cardiopulmonary resuscitation and first aid.  In addition, C.S.H.B. 578
provides that a school district employee who serves as the head coach or
chief sponsor for an extracurricular athletic activity, including
cheerleading, must submit to the district proof of current certification in
first aid and cardiopulmonary resuscitation issued by the American Red
Cross, the American Heart Association, or another organization that
provides equivalent training and certification.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Section 21.451(a), Education Code, to provide that
school district staff development must include training in cardiopulmonary
resuscitation and first aid. Makes nonsubstantive changes. 

SECTION 2.  Amends Subchapter D, Chapter 33, Education Code, by adding
Section 33.086, as follows: 

Sec. 33.086.  CERTIFICATION IN CARDIOPULMONARY RESUSCITATION AND FIRST AID.
Provides that a school district employee who serves as the head coach or
chief sponsor for an extracurricular athletic activity, including
cheerleading, sponsored or sanctioned by a school district or the
University Interscholastic League, must submit to the district proof of
current certification in first aid and cardiopulmonary resuscitation issued
by the American Red Cross, the American Heart Association, or another
organization that provides equivalent training and certification. Requires
each school district to adopt procedures for administration of this section
including the time and manner in which proof of current certification must
be submitted. 

SECTION 3. (a) Provides that Section 21.451(a), Education Code, as amended
by this Act, applies                       beginning with the 1999-2000
school year. 

(b) Provides that Section 33.086, Education Code, as added by this Act,
applies beginning January 1, 2000. 

SECTION 4.  Emergency clause.
  Effective date: upon passage.




 


COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 578 modifies the original in the caption to include reference to
"staff development training." 

C.S.H.B. 578 modifies the original in SECTION 1 by removing the proposed
amendment to Section 28.002 (a), Education Code.  The original proposed to
include specific instructions in the principles and techniques of
cardiopulmonary resuscitation given at least once at the seventh grade
level or above in the required health curriculum. 

C.S.H.B. 578 modifies the original by adding a new SECTION 1 (Section
21.451(a), Education Code) to provide that school district staff
development must include training in cardiopulmonary resuscitation and
first aid.   

C.S.H.B. 578 modifies the original in SECTION 2 (proposed Section 33.086,
Education Code) by providing that a school district employee who serves as
the head coach or chief sponsor, rather than a coach or assistant coach,
for an extracurricular athletic activity, including cheerleading, sponsored
or sanctioned by a school district or the University Interscholastic
League, must submit to the district proof of current certification in first
aid and cardiopulmonary resuscitation issued by the American Red Cross, the
American Heart Association, or another organization that provides
equivalent training and certification.  

C.S.H.B. 578 modifies the original in SECTION 3(a) to provide that Section
21.451(a), Education Code, rather than 28.002 (a)(2)(B), as amended by this
Act,  applies  beginning with the 1999-2000 school year.
