HBA-DMD H.B. 585 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 585 By: West, George State, Federal, & International Relations 3/2/1999 Introduced BACKGROUND AND PURPOSE Under current legal interpretation, library districts (districts) lack the authority to accept grants and donations from public or private sources. H.B. 585 authorizes districts to accept and administer gifts, grants, or donations from any source. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter D, Chapter 326, Local Government Code, by adding Section 326.072, as follows: Sec. 326.072. GIFTS, GRANTS, AND DONATIONS. Authorizes a library district to accept and administer a gift, grant, or donation from any source to carry out the purposes of this chapter (Library Districts). SECTION 2. Emergency clause. Effective date: upon passage.
