HBA-SEB H.B. 58 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 58 By: Cuellar Judicial Affairs 4/6/1999 Introduced BACKGROUND AND PURPOSE Currently, there are three district courts in Webb County. H.B. 58 creates a new judicial district in Webb County which would give priority to cases involving family violence and cases arising under the Family Code and the Health and Safety Code. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter C, Chapter 24, Government Code, by adding Section 24.547, as follows: Sec. 24.547. 402ND JUDICIAL DISTRICT (WEBB COUNTY). Provides that the 402nd Judicial District is composed of Webb County. Requires the 402nd District Court to give priority to cases involving family violence, cases under the Family Code, and cases under the Health and Safety Code. SECTION 2. Amends Section 24.151(f), Government Code, to require the clerk of the district courts to assign and docket to the 402nd District Court all cases involving family violence, all cases under the Family Code, and all cases under the Health and Safety Code. Makes conforming and nonsubstantive changes. SECTION 3. Effective date: January 1, 2001. SECTION 4. Emergency clause.
