HBA-NLM H.B. 614 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 614 By: George County Affairs 2/17/1999 Introduced BACKGROUND AND PURPOSE Currently, counties may not accept donations from foundations, corporations, and individual citizens without specific statutory authority. H.B. 614 authorizes a commissioners court to accept a gift, grant, donation, or other items on behalf of the county. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter B, Chapter 81, Local Government Code, by adding Section 81.032, as follows: Sec. 81.032. ACCEPTANCE OF DONATIONS AND REQUESTS. Authorizes a commissioners court on behalf of the county to accept a gift, grant, donation, bequest, or devise of money or other property to perform a function conferred on the county or a county officer. SECTION 2. Emergency clause. Effective date: upon passage.
