HBA-KMH H.B. 741 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 741 By: Eiland Criminal Jurisprudence 3/30/1999 Introduced BACKGROUND AND PURPOSE Under current law, burglary of a vehicle is punishable as a Class A misdemeanor. H.B. 741 sets the punishment level for burglary of a vehicle at a state jail felony in an attempt to provide a greater deterrent against this type of crime. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 30.04(c), Penal Code, to increase the penalty for the offense of burglary of vehicles to a state jail felony from a Class A misdemeanor. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
