HBA-MPA H.B. 825 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 825 By: Carter Public Safety 3/26/1999 Introduced BACKGROUND AND PURPOSE Currently, a peace officer licensed under Chapter 415 (Commission on Law Enforcement Officer Standards and Education), Government Code, can apply for a reduced-fee concealed handgun license not later than one year after retirement, while a retired federal officer has the right to apply for such a license at any time following retirement. H.B. 825 makes the law consistent, allowing both categories of retired officers to apply for a reduced-fee concealed handgun license at any time following retirement. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 411.199(a), Government Code, to authorize a person licensed as a peace officer who has been employed full-time by a law enforcement agency to apply for a license under Subchapter H (License to Carry a Concealed Handgun), at any time after retirement, rather than not later than the first anniversary after retirement. SECTION 2. Emergency clause. Effective date: upon passage.
