HBA-NLM H.B. 863 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 863 By: Puente Licensing & Administrative Procedure 4/13/1999 Introduced BACKGROUND AND PURPOSE Current law does not subject certain information, such as discussions, thought processes, and individual votes of the members of a grievance committee to discovery or other legal processes. H.B. 863 provides that all information and materials compiled by a grievance committee in connection with a complaint and investigation of an attorney are subject to discovery or other legal process. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 81.072, Government Code, by adding Subsection (h), to provide that all information and materials compiled by a grievance committee in connection with a complaint and investigation of an attorney are subject to discovery or other legal process. SECTION 2. Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3. Emergency clause.
