HBA-DMD H.B. 870 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 870 By: Goodman Juvenile Justice & Family Issues 2/19/1999 Introduced BACKGROUND AND PURPOSE Registry funds are tendered to a county, district, or county and district clerk for deposit into the registry of a court. To compensate the county for the accounting and administrative costs incurred in handling registry funds that have not earned interest, current law allows clerks to withhold a fee in an amount up to $50 at the time the funds are withdrawn. H.B. 870 exempts funds generated by a case arising under the Family Code from such deductions. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 117.055(a), Local Government Code, to exempt a withdrawal of funds generated from a case arising under the Family Code from the fee deduction provided by this section (County Expenses Paid From Fees). SECTION 2.Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 3.Emergency clause.
