HBA-ALS H.B. 925 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 925 By: Janek Licensing & Administrative Procedures 3/30/1999 Introduced BACKGROUND AND PURPOSE Currently, the name of a person who files a complaint with a licensing agency against a holder of a professional license may be withheld from the license holder. H.B. 925 requires a licencing agency to notify a license holder of the name of a person who files a complaint against that license holder, unless it would jeopardize an investigation. This bill exempts from the disclosure requirement a person filing the complaint as a member of a professional review body engaged in peer review. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. DEFINITIONS. Defines "license" and "licensing agency." SECTION 2. DISCLOSURE OF COMPLAINANT. Requires a licensing agency to notify a license holder of the name of a person filing a complaint against that license holder unless notification would jeopardize the investigation. SECTION 3. EXCEPTION. Provides that a person who files a complaint as a member of a professional review body engaged in peer review is exempt from the disclosure required in Section 2. SECTION 4.Effective date: September 1, 1999. Makes application of this Act prospective. SECTION 5.Emergency clause.
