HBA-SEB H.B. 93 76(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 93 By: Reyna, Arthur Human Services 2/9/1999 Introduced BACKGROUND AND PURPOSE Increased life expectancies have caused a growth in the percentage of elderly people in the total population. Many people within this group may require long-term care. In light of this, H.B. 93 establishes a monthly personal needs allowance of at least $60 for certain Medicaid recipients who are residents of long-term care facilities. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 32.024, Human Resources Code, by adding Subsection (v), as follows: (v) Requires the Health and Human Services Commission (department) to set a personal needs allowance of not less than $60 a month for a medically-assisted resident of a licensed long-term care facility. Authorizes the department to send the personal needs allowance directly to a person receiving Supplemental Security Income (SSI). Provides that this subsection does not apply to a resident who participates in a medical assistance waiver program administered by the department. SECTION 2. Effective date: September 1, 1999. Makes the application of this Act prospective. SECTION 3. Emergency clause.
