HBA-DMD H.J.R. 77 76(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 77 By: Krusee State Affairs 4/6/1999 Introduced BACKGROUND AND PURPOSE Currently, state employees who serve as members of various local governing bodies are constitutionally prohibited from receiving direct compensation from the governing bodies on which they serve. As proposed, H.J.R. 77 requires the submission to the voters of a constitutional amendment allowing for certain state employees or other individuals to receive compensation for serving as members of certain governing bodies. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 40, Article XVI, Texas Constitution, to delete the provision prohibiting certain state employees or other individuals from receiving a salary for serving as members of certain local governing bodies. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held November 2, 1999. Sets forth the required language for the ballot.
