HBA-MPM H.J.R. 97 76(R) BILL ANALYSIS Office of House Bill AnalysisH.J.R. 97 By: Bosse Public Education 4/27/1999 Introduced BACKGROUND AND PURPOSE H.J.R. 97 prohibits state employees or other individuals who receive compensation from funds of the State of Texas and who are not State officers from receiving a salary for serving as members of certain governing bodies with the exception of schoolteachers or retired schoolteachers, who are authorized to receive compensation for serving as a member of a governing body of a water district. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 40, Article XVI, Texas Constitution, to prohibit state employees or other individuals who receive all or part of their compensation either directly or indirectly from funds of the State of Texas and who are not State officers from receiving a salary for serving as members of governing bodies of school districts, cities, towns, or other local governmental entities, except that a schoolteacher or retired schoolteacher is authorized to receive compensation for serving as a member of a governing body of a water district created under Section 59, Article XVI or Section 52, Article III. SECTION 2. Requires this proposed constitutional amendment to be submitted to the voters at an election to be held November 2, 1999. Sets forth the required language for the ballot.
