BACKGROUND AND PURPOSE 

Currently, Texas Tech University and the Texas Tech University Health
Science Center operate under one board of regents with same chancellor, a
president over each institution, and meet the definition of a system in the
Texas Education Code, however, the Education Code does not specify that the
institution is part of a system.  S.B. 1088 creates the Texas Tech
University System.  

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that rulemaking
authority is expressly delegated to the board of regents of the Texas Tech
University in SECTION 1 (Section 109.001, Education Code) of this bill. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends the chapter title to Chapter 109, Education Code, as
follows:  

CHAPTER 109. New title: TEXAS TECH UNIVERSITY SYSTEM 

SECTION 2.  Amends Subchapter A, Chapter 109, Education Code, by adding
Section 109.001,as follows:  

Sec. 109.001.  TEXAS TECH UNIVERSITY SYSTEM. (a) Creates the Texas Tech
University System (system), which is composed of all institutions and
entities presently under the governance, control, jurisdiction, and
management of the board of regents (board) of the Texas Tech University. 

(b)  Requires the system to be composed of other institutions and entities
as from time to time, as assigned by specific legislative act to the
governance, control, jurisdiction, and management of the system.   

(c)  Provides that the governance, control, jurisdiction, organization, and
management of the system is vested in the board, known and designated as
the Board of Regents of the Texas Tech University System.  Authorizes the
board, by rule, to delegate a power or duty of the board to an officer,
employee, or other agent of the board.  

SECTION 3.Emergency clause.
  Effective date: upon passage.

EXPLANATION OF AMENDMENTS

COMMITTEE AMENDMENT #1:

Amend S.B. 1088 by striking SECTION 3 of the engrossed bill, and adding the
following sections: 

SECTION __.  Effective date:  September 1, 1999, except as provided by
Subsection (b), which requires the Texas Higher Education Coordinating
Board (board) to review and determine whether to approve the creation of
the Texas Tech University System as provided by this Act, and which
provides that if the board does not approve its creation before August 31,
1999, the system is not created and this Act has no effect.
