HBA-MPA S.B. 1114 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1114 By: Armbrister Licensing & Administrative Procedures 5/3/1999 Engrossed BACKGROUND AND PURPOSE Currently, the Texas Alcoholic Beverage Commission is authorized to promulgate rules setting definite limitations consistent with the general provisions of the Alcoholic Beverage Code, relaxing the restrictions of certain sections of the code. S.B. 1114 authorizes the Texas Alcoholic Beverage Commission to promulgate such rules with respect to Section 102.07 (Prohibited Dealings With Retailer or Consumer). RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 108.04, Alcoholic Beverage Code, to authorize the Texas Alcoholic Beverage Commission to promulgate rules which set definite limitations consistent with the general provisions of this code, relaxing the restrictions of Section 102.07 (Prohibited Dealings With Retailer or Consumer). Makes a nonsubstantive change. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
