HBA-MPA S.B. 1279 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1279 By: Wentworth County Affairs 5/9/1999 Engrossed BACKGROUND AND PURPOSE Currently, there are often delays in the emergency communication districts' budget approval process which adversely affect the operation of the public safety system. S.B. 1279 streamlines the budget approval process of emergency communication districts. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 772.309, Health and Safety Code, to require the governing body of a county, municipality, or other participating jurisdiction (body) to approve the budget of an emergency communication district unless the body finds that the board of managers of the emergency communication district abused its discretion in preparing the budget. Provides that the budget is approved by operation of law, if the body does not approve or disapprove the budget before the 61st day after the body receives the budget for review. Make conforming changes. SECTION 2. Effective date: September 1, 1999.
