HBA-MPM S.B. 1331 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1331 By: Moncrief Public Health 5/11/1999 Engrossed BACKGROUND AND PURPOSE With the rollout of Medicaid managed care in Texas, the state has yet to evaluate the impact of managed care on both quality of care and costs. S.B.1331 requires that the state to evaluate the success and data of Texas Medicaid Managed Care programs. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 2, Chapter 1262, Acts of the 75th Legislature, Regular Session 1997, by adding Subsections (i) and (j), as follows: (i) Requires the Health and Human Services Commission (HHSC) to assess the effectiveness of current managed care contracts, prior to the issuance of a request for application or other solicitation document for any additional contracts with managed care organizations. Requires the assessment to include an evaluation of the impact of the managed care delivery system, including health maintenance organizations, prepaid health plans, and primary care case management with respect to certain related issues. (j) Requires HHSC to consult with certain entities, state agencies and political subdivisions with a constitutional or statutory obligation to provide health care for the indigent. SECTION 2. Requires the assessment required under this Act to be completed and a report to be submitted to the governor, lieutenant governor, speaker of the house of representatives, and chairs of the standing committees of the senate and house of representatives with primary jurisdiction over health services no later than December 1, 2000. SECTION 3. Makes this Act take effect only if a specific appropriation for its implementation is provided in H.B. 1 (General Appropriations Act), Acts of the 76th Legislature, Regular Session, 1999. Provides that if no appropriation is made under that Act, this Act has no effect. SECTION 4.Emergency clause. Effective date: upon passage.
