BACKGROUND AND PURPOSE

Current law exempts libraries operated as a part of a university system or
institution of higher education from the normal purchasing requirements set
forth for those institutions. These libraries are subject only to the
internal policies of the institutions of which they are a part. This
exemption does not apply to junior colleges. S.B. 1363 authorizes the
acquisition of library materials by a junior college district, in the same
manner authorized for senior colleges and universities.

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution.
