BACKGROUND AND PURPOSE 

Under current law, only a county with a population of 20,000 or less and a
municipality in that county with a population of 10,000 or more, may
jointly erect, acquire, equip, or operate an auditorium.  Such counties and
municipalities are prohibited from jointly erecting, acquiring, equipping,
or operating an exposition center, a civic center, or a convention center. 

S.B. 1512 authorizes the commissioners court of a county, and the governing
body of a municipality in that county, to jointly erect, acquire, equip,
maintain, and operate a recreational or cultural facility, by amending the
Local Government Code to delete population requirements and to provide that
auditoriums, civic centers, convention centers, and exposition centers are
all defined as "recreational and cultural facilities." 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends the heading of Chapter 301, Local Government Code, as
follows: 

CHAPTER 301.  RECREATIONAL AND CULTURAL FACILITIES
JOINTLY ESTABLISHED BY COUNTIES AND MUNICIPALITIES

Deletes "Auditorium" from the Chapter Heading.

SECTION 2.  Amends Sections 301.001, 301.002, 301.003, 301.006, 301.007,
and 301.008, Local Government Code, as follows: 

Sec. 301.001.  New title:  AUTHORITY TO ESTABLISH RECREATIONAL OR CULTURAL
FACILITY.  (a)  Provides that, in this chapter, "recreational or cultural
facility" means an auditorium, civic center, convention center, or
exposition center. Deletes "auditorium" from the title. 

(b) Authorizes a commissioners court of a county and the governing body of
a municipality in that county to jointly erect, acquire, equip, maintain,
and operate a recreational or cultural facility. Deletes provisions
authorizing the commissioners court of a county with a population of 20,000
or less and the governing body of a municipality in that county with a
population of 10,000 or more to perform those functions with respect to an
auditorium. 

Sec. 301.002.  New title:  FINANCING OF RECREATIONAL OR CULTURAL FACILITY.
Makes a conforming change. 

Sec. 301.003.  DELEGATION OF AUTHORITY TO BOARD OF MANAGERS; DONATION.  (a)
Makes  conforming changes. 

(b)  Makes a conforming change.
 
Sec. 301.006.  AUTHORITY OF BOARD TO CONTRACT.  Makes conforming changes.

Sec. 301.007.  FINANCIAL STATEMENT AND BUDGET.  (a) Makes conforming
changes.   

(b)  Makes conforming and nonsubstantive changes.

Sec. 301.008.  PERSONNEL.  Makes conforming changes.

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
