HBA-TYH S.B. 1796 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1796 By: Wentworth State Affairs 5/7/1999 Engrossed BACKGROUND AND PURPOSE Currently, subscribers to the Texas Department of Public Safety Crime Bulletin are required to reapply each year. The bulletin editor is concerned that because of this requirement, each year subscribers who need to receive the bulletin are lost. S.B. 1796 limits the application of certain laws regarding the distribution of publications by state agencies, depending upon actions taken by the head of the state agency. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Subchapter C, Chapter 2052, Government Code, by adding Section 2052.207, as follows: Sec. 2052.207. EXCEPTION TO CERTAIN DISTRIBUTION REQUIREMENTS. Provides that Sections 2052.202 (Publication Request Form), 2052.203 (Publication Distribution List), and 2052.204 (Distribution) do not apply to the distribution of a publication during a calendar year by a state agency if the head of the agency: (1) determined by December 31 of the previous calender year that the publication will be distributed during the year by a reasonably accurate mailing list; (2) determined that it would not be cost-effective to recreate the mailing list for a publication under Sections 2052.202, 2052.203, and 2052.204; and (3) not later than December 31 of the previous calendar year, notified in writing the following persons of each publication to which Sections 2052.202, 2052.203, and 2052.204 will not apply during the calendar year: the governor, the lieutenant governor, the speaker of the house of representatives, the comptroller, and the state auditor. SECTION 2. Effective date: September 1, 1999.
