HBA-JRA S.B. 1831 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1831 By: Shapiro Judicial Affairs 5/10/1999 Engrossed BACKGROUND AND PURPOSE Currently, the Dallas County criminal district attorney is not included under the provisions of the Professional Prosecutors Act. S.B. 1831 includes the criminal district attorney for Dallas County among the prosecutors to which Chapter 46, Government Code (Professional Prosecutors), applies. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 46.002(2), Government Code, to include the criminal district attorney for Dallas County among the prosecutors to which Chapter 46, Government Code (Professional Prosecutors), applies. SECTION 2. Repealer: Subsections (e)-(g), Section 44.157, Government Code (Dallas County), relating to compensation for a criminal district attorney of Dallas County and prohibiting the criminal district attorney from engaging in the private practice of law. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
