HBA-KMH S.B. 1839 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 1839 By: Bivins Judicial Affairs 5/10/1999 Engrossed BACKGROUND AND PURPOSE Currently, under Texas law, the state pays Oldham County attorneys 30 percent of the salary paid to a district attorney by the state. However, there has been an increase in the case-load for county attorneys and Oldham County is requesting that the county attorneys' salary be equal to district attorneys with Oldham County contributing $28,500 and the state contributing the remainder. S.B. 1839 increases the salary of Oldham County attorneys to equal the salary of district attorneys. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 45.280, Government Code, to require the county attorney in Oldham County to represent the state in all matters pending before the district court in Oldham County. Provides that the county attorney in Oldham County is entitled to be compensated by the state in the manner and amount provided by general law relating to the salary paid to district attorneys by the state. Requires Oldham County to pay $28,500 of the county attorney's total salary, and requires the state to pay the remainder of the salary. Deletes text entitling Oldham County to receive an amount from the state equal to 30 percent of the salary paid to a district attorney by the state. SECTION 2. Effective date: September 1, 1999. SECTION 3. Emergency clause.
