HBA-KMH S.B. 216 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 216 By: Duncan Criminal Jurisprudence 3/23/1999 Engrossed BACKGROUND AND PURPOSE Currently, Texas law does not prohibit a person convicted of theft from serving on a grand jury. S.B. 216 disqualifies a person convicted of theft from selection or service as a grand juror. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Article 19.08, Code of Criminal Procedure, to prohibit a person from serving as a grand juror who has been convicted of a theft. SECTION 2. Makes application of this Act prospective. SECTION 3. Effective date: September 1, 1999. SECTION 4. Emergency clause.
