HBA-MPM S.B. 234 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 234 By: Ellis Human Services 3/28/1999 Engrossed BACKGROUND AND PURPOSE Current law requires certain state agencies to file a roster or list of licensees with the secretary of state. The secretary of state then makes a record of the filing and transfers the report to the State Library and Archives Commission for long-term retention. S.B. 234 deletes the requirement of filing the roster or list of licensees with the secretary of state in order to streamline the record-keeping process. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 50.008(a), Human Resources Code, to delete the requirement that copies of a roster of all licensed master social workers, licensed social workers, and social work associates licensed by the Texas State Board of Social Worker Examiners be placed on file with the secretary of state. SECTION 2. Amends Section 11, Article 3271a, V.T.C.S. (Texas Engineering Practice Act), to delete the requirement that copies of a roster showing the names and places of all businesses of all licensed professional engineers be placed on file with the secretary of state. SECTION 3. Amends Section 5, Article 4512b, V.T.C.S. (Chapter 94, Acts of the 51st Legislature, Regular Session, 1949), to delete the requirement that, on May 1st of each year, an official copy of a register of certain information regarding chiropractors be transmitted to the secretary of state for permanent record. Makes conforming changes. SECTION 4. Amends Section 18, Article 4512c, V.T.C.S. (Psychologists' Licensing Act), to delete the requirement that a copy of a list of all certified or licensed psychologists be filed with the secretary of state. SECTION 5. Amends Section 4(b), Article 4512e, V.T.C.S. (Chapter 836, Acts of the 62nd Legislature, Regular Session, 1971), to delete the requirement that the coordinator of physical therapy programs transmit an official copy of the list of physical therapist licensees to the secretary of state for permanent record. SECTION 6. Amends Section 2.06(b), Article 4552-2.06, V.T.C.S. (Texas Optometry Act), to delete the requirement that a certified copy of records containing certain information about each applicant for examination for licensure in optometry be sent to the secretary of state for permanent record on or before September 1 of each year. Makes a conforming change. SECTION 7. Amends Section 2(E)(2), Article 4528b, V.T.C.S. (Chatper 251, Acts of the 53rd Legislature, Regular Session, 1953), to delete the requirement that a copy of the names of all duly licensed funeral directors, embalmers, and funeral establishments be filed with the secretary of state for permanent record. Makes a conforming change. SECTION 8. Amends Section 3(f), Article 8851, V.T.C.S. (Occupational Therapy Practice Act), to delete the requirement that an official copy of the list of all licensed occupational therapists be transmitted to the secretary of state for permanent record. SECTION 9. Amends Section 8(b), Article 8885, V.T.C.S. (Property Taxation Professional Certification Act) to delete the requirement that the roster of all persons registered with the Board of Tax Professional Examiners, as well as certain information, be placed on file with the secretary of state. SECTION 10. Amends Section 11(b), Article 8920, V.T.C.S. (Orthotics and Prosthetics Act), to delete the requirement that an official copy of a register of license holders under this Act be sent annually to the secretary of state for permanent record. SECTION 11. Effective date: September 1, 1999. SECTION 12. Emergency clause.
