BACKGROUND AND PURPOSE 

Current law prohibits release on bail of a defendant pending appeal from a
felony conviction where the punishment exceeds 15 years.  S.B. 306
prohibits release on bail of a defendant pending appeal from a felony
conviction where the punishment equals or exceeds 10 years. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends Subsections (b) and (c), Article 44.04, Code of Criminal
Procedure, to prohibit release on bail of a defendant pending appeal from a
felony conviction where the punishment equals or exceeds 10 years, rather
than exceeds 15 years.  Deletes a reference to a repealed statute and
refers instead to the recodified statute.  Makes a conforming change. 

SECTION 2.  Makes application of this Act prospective.

SECTION 3.  Effective date: September 1, 1999.

SECTION 4.  Emergency clause.
