HBA-MPA S.B. 616 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 616 By: Brown Licensing & Administrative Procedures 5/6/1999 Engrossed 5/6/1999 BACKGROUND AND PURPOSE Currently, the sunset date for the Texas Lottery Commission (commission) is September 1, 2003. Texas law requires a contract between the commission and the lottery operator to terminate on or before September 1, 2004. This automatic termination date restricts the next lottery operator contract to a maximum of two years which would put the commission at a disadvantage when it begins to negotiate a new contract. S.B. 616 allows the contract to be terminated without penalty should the lottery division of the commission be abolished. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 466.003(b), Government Code, to provide that a contract between the lottery division, established by the Texas Lottery Commission under Chapter 467 (Texas Lottery Commission), and a lottery operator under Section 466.014(b) (Powers and Duties of Commission and Executive Director) must contain a provision allowing the contract to be terminated without penalty should the division be abolished, rather than terminate on or before September 1, 2004. SECTION 2.Emergency clause. Effective date: upon passage.
