HBA-EVB C.S.S.B. 643 76(R) BILL ANALYSIS Office of House Bill AnalysisS.B. 643 By: Truan State, Federal & International Relations 4/30/1999 Engrossed BACKGROUND AND PURPOSE Currently, the criteria and guidelines used to grant military awards are specified in the Government Code. S.B. 643 removes those criteria and guidelines from the code, giving the adjutant general greater flexibility in the adoption of rules and regulations governing the granting of certain military awards. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority previously delegated to the adjutant general is modified in SECTION 1 (Section 431.134, Government Code) of this bill. SECTION BY SECTION ANALYSIS SECTION 1. Amends Section 431.134, Government Code, to delete the requirements and guidelines concerning who is eligible to receive the Texas Faithful Service Medal, the Federal Service Medal, the Texas Medal of Merit, the Texas Outstanding Service Medal, the Texas State Guard Service Medal, the Texas Desert Shield/Desert Storm Campaign Medal, and the Texas Humanitarian Service Medal. Includes the Texas Humanitarian Service Medal among the types of medals for which the adjutant general is authorized to adopt rules and regulations. Makes a conforming change. SECTION 2. Emergency clause. Effective date: upon passage.
