BACKGROUND AND PURPOSE 

Currently, Chapter 682, Transportation Code, allows for administrative
adjudication of vehicle parking and stopping offenses in multiple
municipality districts enforced by a joint board created under Chapter
22.074 (Joint Board), Transportation Code.  S.B. 787 extends the definition
to include an administrative board at an airport that resides
simultaneously in two municipalities. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

SECTION BY SECTION ANALYSIS

SECTION 1.  Amends the heading to Chapter 682, Transportation Code, as
follows: 

New title: CHAPTER 682.  ADMINISTRATIVE ADJUDICATION OF VEHICLE PARKING AND
STOPPING OFFENSES.  Deletes "in Certain Municipalities." 

SECTION 2.  Amends Sections 682.001, 682.002, 682.003, and 682.004,
Transportation Code, as follows: 

Sec. 682.001.  APPLICABILITY.  Provides that this chapter applies to an
airport operated by a joint board to which Section 22.074(d),
Transportation Code, applies (board).  Creates new subdivisions from
existing text and makes nonsubstantive changes. 

Sec. 682.002.  CIVIL OFFENSE. Authorizes a board to declare a violation of
a resolution, rule, or order of the board relating to parking or stopping a
vehicle to be a civil offense. Makes a nonsubstantive change. 

Sec. 682.003.  New Title:  ADOPTION OF HEARING PROCEDURE.  Authorizes a
board by rule, resolution, or order to establish an administrative
adjudication hearing procedure under which a civil fine may be imposed.
Deletes "Ordinance Establishing" from existing title. 

Sec. 682.004.  CONTENT OF ORDINANCE.  Makes conforming changes.

SECTION 3.  Amends Section 682.009(b), Transportation Code, to make a
conforming change. 

SECTION 4.  Amends Section 682.010, Transportation Code, to provide that an
order issued under Section 682.009,  may be enforced by denying issuance of
or revoking a parking or operating permit, as applicable. 

SECTION 5.  Amends Section 682.011(c), Transportation Code, to make
conforming and nonsubstantive changes. 

SECTION 6.Emergency clause.
  Effective date: upon passage.
