HBA-CMT, DMH H.B. 1193 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1193 By: Brimer Licensing & Administrative Procedures 2/28/2001 Introduced BACKGROUND AND PURPOSE Current law prohibits fans from bringing alcoholic beverages onto the premises where automobile races if alcoholic beverages are sold there. House Bill 1193 allows, under certain conditions, persons to bring onto and consume alcoholic beverages on premises licensed or permitted for the sale of alcoholic beverages where automobile races are held. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that rulemaking authority is expressly delegated to the Texas Alcoholic Beverage Commission in SECTION 1 (Section 109.61, Alcoholic Beverage Code) of this bill. ANALYSIS House Bill 1193 amends the Alcoholic Beverage Code to require a license or permit holder authorized to sell alcoholic beverages for on-premises consumption to allow a person to bring onto and consume an alcoholic beverage on the licensed or permitted premises if the premises are located in a facility open to the general public where: _automobile racing events are held; and _members of the general public are allowed to bring in and consume alcoholic beverages. The bill does not require the license or permit holder to allow a person to bring or consume an alcoholic beverage on the licensed or permitted premises if the type of alcoholic beverage is not allowed: _in the facility where the premises are located; or _under the terms of the license or permit covering the premises. The bill authorizes the Texas Alcoholic Beverage Commission to adopt rules as necessary to implement this section. EFFECTIVE DATE September 1, 2001.
