HBA-TBM, EDN H.B. 121 77(R)BILL ANALYSIS Office of House Bill AnalysisH.B. 121 By: West, George "Buddy" Public Safety 7/9/2001 Enrolled BACKGROUND AND PURPOSE Prior to the 77th Legislature, a person subject to registration as a sex offender who was not supervised by a juvenile probation officer, community supervision and corrections department officer, or parole officer (officer) was required to report to the local law enforcement authority any change in the person's physical health or job status. A person subject to registration as a sex offender who was being supervised by an officer was not required to report such changes to a local law enforcement authority. However, an officer supervising the person was required to notify the local law enforcement authority if the officer received information to that effect. House Bill 121 requires any person subject to registration as a sex offender to report such changes. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 121 amends the Code of Criminal Procedure to require a sex offender with a reportable conviction or adjudication who is subject to registration to report to the local law enforcement authority any change in the person's physical health or job status. Current law requires that a person subject to registration report to local law enforcement authorities any change in the person's physical health or job status if the person was not being supervised by a juvenile probation officer, community supervision and corrections department officer, or parole officer. EFFECTIVE DATE September 1, 2001.
