HBA-JLV C.S.H.B. 1212 77(R) BILL ANALYSIS Office of House Bill AnalysisC.S.H.B. 1212 By: Dunnam Higher Education 2/25/2001 Committee Report (Substituted) BACKGROUND AND PURPOSE Current state law permits students at public colleges and universities in Texas the option to pay tuition in installments for fall and spring semesters, but not for summer sessions. C.S.H.B. 1212 provides these students with the option to pay summer tuition and fees in three installments. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS C.S.H.B. 1212 amends the Education Code to require the governing board of each institution of higher education to permit a student enrolled for a summer session to pay tuition and fees in three installments. The bill sets forth provisions for the timing and amounts of the installments. The bill authorizes the governing board of the institution to collect incidental fees for students utilizing the installment payments. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001. COMPARISON OF ORIGINAL TO SUBSTITUTE The substitute modifies the original by providing that the Act only applies to tuition and fees charged for a semester or summer session that begins on or after the effective date of the Act.
