BACKGROUND AND PURPOSE 

Current law does not provide for a  single report that identifies all of
the state Medicaid expenditures to be submitted to the Legislature.
C.S.H.B. 1369 requires the Health and Human Services Commission (HHSC) to
prepare a quarterly and a biennial Medicaid financial report covering each
state agency that administers any part of the state Medicaid program and
each of the Medicaid programs operated or administered by those agencies. 

RULEMAKING AUTHORITY

It is the opinion of the Office of House Bill Analysis that this bill does
not expressly delegate any additional rulemaking authority to a state
officer, department, agency, or institution. 

ANALYSIS

C.S.H.B. 1369 amends the Government Code to require the Health and Human
Services Commission (HHSC) to prepare a biennial Medicaid financial report
covering each state agency that administers any part of the state Medicaid
program and each of the Medicaid programs operated or administered by those
agencies. The biennial report must describe each of the Medicaid programs
administered or operated by each agency, and for each of these Medicaid
programs, account for all of the funds received and disbursed during the
period covered by the biennial report, and include the amount of any
allocated federal medical assistance funds, the amount of any funds
appropriated by the legislature, the amount of medical assistance payments
and related expenditures, the amount and source of funds or other revenue
received or made available to an agency, the amount spent on each type of
service or benefit, and the amount spent on program operations and
administrative costs.  No later than December 1st of each even-numbered
year, HHSC is required to submit the report to the governor, the lieutenant
governor, the speaker of the house of representatives, the state auditor,
the comptroller, and the presiding officer of each standing committee of
the senate and house of representatives having jurisdiction over health and
human services issues.   

The bill also requires HHSC to prepare a  quarterly report regarding the
Medicaid expenditures of each state agency that administers or operates a
Medicaid program.  The quarterly report must identify each agency's
expenditures by the Medicaid program and must include the amount spent on
each type of service or benefit and the amount spent on program operations
and administrative costs.  HHSC is required to submit the quarterly report
to the governor, the legislature, the state auditor, and the comptroller. 

EFFECTIVE DATE

On passage, or if the Act does not receive the necessary vote, the Act
takes effect September 1, 2001. 

COMPARISON OF ORIGINAL TO SUBSTITUTE

C.S.H.B. 1369 modifies the original by adding the state auditor to the list
of entities to which the Health and Human Services Commission is required
to submit the biennial and quarterly financial reports.
