HBA-SEP, MPM H.B. 143 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 143 By: Deshotel Public Health 3/4/2001 Introduced BACKGROUND AND PURPOSE In 1998, the Texas Department of Health and the Bureau of Food and Drug Safety's Retail Foods Division adopted the Texas Food Establishment Rules to promote uniformity in health inspection reports throughout the state. While state law requires an establishment to post its permit, there is no state requirement to post health inspection reports. By providing such a report to the consumer, the consumer would be informed on the health status of the establishment. House Bill 143 requires food service establishments to post the report of an inspection in a conspicuous place for at least 60 days after the inspection. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 143 amends the Health and Safety Code to require a food service establishment, retail food store, mobile food unit, roadside food vendor, or temporary food service establishment to conspicuously post the report of an inspection performed by the Texas Department of Health, a public health district, a county, or a municipality for at least 60 days after the date of the inspection. EFFECTIVE DATE September 1, 2001.
