HBA-KDB H.B. 1528 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1528 By: Bailey State Affairs 2/26/2001 Introduced BACKGROUND AND PURPOSE Under current law, an official of the state or a political subdivision of the state is prohibited from entering into a collective bargaining contract with a labor organization regarding wages, hours, or conditions of employment of public employees. In addition, public employees are explicitly prohibited from engaging in a strike. House Bill 1528 modifies this provision to ensure that only those labor organizations that do not advocate the right of a public employee to strike are authorized to enter into negotiations concerning wages, hours, or conditions of employment with the appropriate public authorities. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1528 amends the Government Code to prohibit collective bargaining between an official of the state or a political subdivision of the state and certain labor organizations representing public employees that advocate the right of public employees to strike . EFFECTIVE DATE September 1, 2001.
