HBA-JEK H.B. 1582 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1582 By: Gallego Corrections 3/4/2001 Introduced BACKGROUND AND PURPOSE The primary role of the Board of Pardons and Paroles is to administer the discretionary release of eligible inmates from the Institutional Division of the Texas Department of Criminal Justice to a plan of parole supervision. Current law requires the Board of Pardons and Paroles Policy Board (policy board) to establish caseloads and duties for its board members, but is unclear on whether the policy board has the authority to establish required work hours. House Bill 1582 clarifies the law by authorizing the policy board to establish required work hours for its members. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1582 amends the Government Code to require the Board of Pardons and Paroles Policy Board to establish required work hours for members of the Board of Pardons and Paroles (board) within 30 days of the effective date of this bill. The bill requires members of the board to file activity reports that include the hours worked by board members beginning with the first activity report filed after the board requirement has been in effect for one month. EFFECTIVE DATE On passage, or if the Act does not receive the necessary vote, the Act takes effect September 1, 2001.
