HBA-DMH H.B. 1718 77(R) BILL ANALYSIS Office of House Bill AnalysisH.B. 1718 By: Davis, Yvonne Transportation 2/27/2001 Introduced BACKGROUND AND PURPOSE Under current law, appointments to the board of directors of the North Texas Tollway Authority are made by the governor and the commissioners court of each of the four counties in which the turnpike project is located. Because the governor makes three of the seven appointments, the governor has greater appointment authority than the commissioners court of each county. House Bill 1718 requires the governor to make one appointment to the board of directors of a regional tollway authority, and requires the commissioners courts of the counties of the authority to make the remaining appointments. RULEMAKING AUTHORITY It is the opinion of the Office of House Bill Analysis that this bill does not expressly delegate any additional rulemaking authority to a state officer, department, agency, or institution. ANALYSIS House Bill 1718 amends the Transportation Code to reduce from three to one the number of directors the governor appoints to the board of directors of a regional tollway authority. The one director appointed by the governor must have resided for at least one year in a county outside the authority that is adjacent to a county of the authority. The bill sets forth provisions for the manner in which the remaining appointments are to be made by a commissioners court of a county of the authority. EFFECTIVE DATE September 1, 2001.
